Notable Appellate & Trial Experience

  • Vasquez v. Franklin Management: Successfully won on appeal before the 2nd Appellate District (Division 8). This landmark case addressed whether an employer’s refusal to reimburse mileage — which effectively dropped an employee’s hourly wage below the minimum — constituted intolerable working conditions. The court ruled that such failures regarding low-wage earners justify a constructive discharge claim under California Labor Code Section 2802.
  • Dominguez v. Washington Mutual Bank (2008) 168 Cal.App.4th 714: Won a critical appeal involving the “continuing violation doctrine.” The court held that the Plaintiff’s DFEH complaint was timely despite falling outside the standard one-year deadline, as the conduct was frequent, similar in nature, and had not yet reached a degree of permanence (CACI 2508).
